強制失踪から 4 年、市民社会が問い続ける: 「ソムバット・ソムポーンはどこに?」

バンコク発)ラオスの傑出したラオスの市民社会のリーダー、ソム バット・ソムポーン氏が強制失踪に遭ってから 4 年目を迎えるこの日、私たち、以下に署名 をした団体は、ソムバット氏の失踪を今に至るまで適切に調査せずにいるラオス政府を非 難します。私たちは、ラオス当局に、ソムバット氏の安否や所在を突き止めるための効果的 な調査を行うよう求めます。特に、12 か月前に新しい証拠となるビデオが公開された後も、 彼の強制失踪に関する調査を再開しないラオス政府の怠慢を非難します。

ソムバット氏は、2012 年 12 月 15 日の夜、ラオスの首都ビエンチャンの交通量の多い道路 沿いの警察の検問所で見かけられたのを最後に、姿を消しました。ソムバット氏の誘拐は、 検問所近くに設置された防犯カメラに捉えられています。防犯カメラの映像は、警察官がソ ムバット氏の車を止め、数分後に身元不明の人物たちが彼を他の車に押し込み、走り去ると ころを映しています。また、何者かが、ソムバット氏の車を運転して街から走り去るところ も映されています。

2015 年 12 月、ソムバット氏の家族は、同じ地区の防犯カメラの映像を入手し、公開しまし た。そのビデオには、何者かが運転するソムバット氏の車が、街に向かって戻ってくるとこ ろが映されています。このことから、少なくとも、その車が街に向かって戻る主なルート沿 いにある他の防犯カメラの映像を見直すべき状況となったはずでした。

ソムバット氏の家族によって新しい証拠が公開されてから、ラオス当局は、調査に向けて何 の行動も起こしていないか、(仮に調査をしていたとしても)何ら新しい所見を公開してい ません。警察による最後の報告書が発表されたのは、2013 年 6 月 8 日です。(事件から)4 年が経ち、ラオス政府がソムバット氏の強制失踪に対して、本気で効果的な調査をしてこな かったことと、それをしようとする政治的意志が全くないことは明らかです。

また、私たちは、ラオス当局に対し、強制失踪の被害者である他の 10 人の安否と所在につ いての情報を提供することも求めます。当局は、2009 年 11 月に、民主化を求めるデモに参 加しようとしていたとして、Kingkeo と Somchit という 2 人の女性と、Soubinh、Souane、 Sinpasong、Khamsone、Nou、Somkhit、Sourigna という 7 人の男性を拘束しました。 2007 年 1 月には、ルアンナムター県で中国資本の農業プロジェクトを批判した Somphone Khantisouk が、何者かに誘拐され、行方不明になっています。

ラオス政府がソムバット・ソムポーン氏と他の 10 人の活動に対してこうした行為を行い、彼らの自由を剥奪したことを認めずにいることは、「強制失踪防止条約(ICPPED)」の第 2 条による強制失踪に相当します。ラオスは 2008 年 9 月に ICPPED に署名しているのにも 関わらず、まだこの条約を批准していません。ラオス政府は、ただちに ICPPED を批准し、 その必要条件を効果的に実施できるよう国内法を採択し、将来、誰も強制失踪に遭うことが ないようにすべきです。

ラオス政府が全ての強制失踪事件に対して適切な調査を行わずにいることは、ラオスも締 約国となっている「市民的及び政治的権利に関する国際規約(ICCPR)」の 2 条 3 項に基づ く義務に違反しています。ICCPR は、政府はこの規約で補償されている権利―それには人 間の自由と安全に対する権利も含まれる―の侵害に対し「効果的な対策」を講じなくてはな らないとしています。

私たちは、ラオス政府に対し、ソムバット氏の強制失踪に関する基本的な事実を否定するこ とを止め、ただちに彼の失踪と、他の全ての強制失踪事件に対して、的確で、公平で、効果 的かつ徹底した調査を行うことを要請します。

私たちは、世界中の個人、組織、政府が、この要請に賛同し、ラオス政府に以下の質問に答 えるよう要求することをお願いします。「ソムバット・ソムポーン氏はどこに?」
